TANGGUNG JAWAB PEMERINTAH DAERAH KABUPATEN BADUNG TERHADAP TENAGA HONORER YANG TIDAK DAPAT DIANGKAT MENJADI CALON PEGAWAI NEGERI SIPIL* Oleh: I Putu Agus Astra Wigoena** Ibrahim R.*** I Ketut Suardita**** Program Kekhususan Hukum Pemerintahan Fakultas Hukum Universitas Udayana Abstrak Tenaga honorer yang dapat diangkat sebagai CPNS (Calon Pegawai Negeri Sipil) antara lain tenaga guru, tenaga penyuluh dibidang pertanian, tenaga kesehatan, tenaga peternakan, tenaga perikanan dan adapun tenaga teknisi lainnya dalam instansi pemerintahan. Maka dari itu pemerintah harus bertanggung jawab dan memberikan solusi atas masalah tersebut. Adapun permasalahan dalam penelitian ini yaitu bagaimanakah pengaturan mengenai tenaga honorer menjadi calon pegawai negeri sipil dan bagaimana tanggung jawab Pemerintah Daerah Kabupaten Badung terhadap tenaga honorer yang tidak dapat diangkat menjadi calon pegawai negeri sipil. Tujuan penelitian ini untuk menganalisis pengaturan tenaga honorer menjadi CPNS, dan menganalisis tanggung jawab Pemerintah Daerah Kabupaten Badung terhadap tenaga honorer yang tidak dapat diangkat menjadi CPNS. Hasil analisis dengan menggunakan metode penelitian hukum empiris ditemukan bahwa pasal 99 Undang– Undang Aparatur Sipil Negara No. 5 Tahun 2014 menyatakan CPNS yang berasal dari PPPK (Pegawai Pemerintah dengan Perjanjian Kerja) tidak otomatis dilakukan pengangkatan, namun PPPK perlu mengikuti pemilihan yang diadakan untuk menjadi CPNS. Tanggung Jawab Pemerintah Daerah Kabupaten Badung yaitu memberikan penghargaan pada tenaga honorer bila menunjukkan kinerja yang baik selama bekerja berupa tanda kehormatan, kesempatan prioritas untuk pengembangan kompetensi berupa seminar ataupun penataran, dan juga kesempatan menghadiri acara kenegaraan. Abstract Honorary staff who can be appointed as CPNS (Candidates For Civil Servants) include teachers, extension workers in the field of agriculture, health workers, livestock workers, fisheries and other technicians in government agencies. Therefore the government must be responsible and provide solutions to the problem. The problems in this article are how the arrangement of honorary staff to be a civil servant candidate and how the responsibility of the local government of Badung regency to the honorary staff who can not be appointed as candidates for civil servants. The purposes of this study are to analyze the arrangement of honorary staff into CPNS, and analyze the responsibilities of local government of Badung regency to the honorary staff who can not be appointed to CPNS. The results of the analysis using empirical legal research method found that article 99 of the Civil State Apparatus Act no. 5 Year 2014 states CPNS coming from PPPK (Government employees with employment agreements) is not automatically out appointed, but the PPPK needs to follow the election held to become CPNS. The responsibility of the local government of Badung Regency is to reward honorary staffs when showing good performance during the work in the form of honor signs, priority opportunities for competence development in the form of seminars or upgrading, as well as the opportunity to attend state events.
