Hoax is a false news to deceive or fool the reader / listener to believe something, even though the fake news disseminator knows that the news is fake. In the era of digital technology, not only text content can be manipulated, but also other content in the form of photos or videos. Hoax is a prohibited and criminal act, both in the ITE Law and the Criminal Code.
The Criminal Code and the ITE Law have not yet regulated the types of hoaxes, so certain types of acts have not yet been regulated or there is still a legal vacuum. Changes to the ITE Law have not covered the "material feit" of the types of hoaxes that have developed in Indonesia.
For acts of spreading false news with political intentions / goals (for example the Ridwan Kamil hoax case) or the spread of hoaxes that have quite serious impacts, such as hoaxes which result in clashes between villages, where there is still a legal vacuum. The legal vacuum hasn't been covered in Law No. 9 of 2016 concerning changes to Law No. 11 of 2008 concerning Electronic Information and Transactions. The revised Law on Information and Electronic Transactions (UU ITE) officially takes effect after 30 days have passed since it was passed into law on October 27, 2016. And will take effect on Monday (11/28/2016). There are some changes in the new ITE Law.
