Teks with Lawful Cases: forensic linguistics study

Abstrak

In this research, it is proven that language is legal evidence and language is legal discourse. In this case, language as legal evidence is associated with efforts to determine the author / speaker of the text and the meaning / purpose of the text. Meanwhile, language as a legal discourse includes the language of the law, rules, language in court and debates between judges, lawyers and parties on trial (Olsson and Luchjenbroers, 2014: 1).

 

In connection with the study of texts that have the potential to cause legal cases, the Indonesian National Police (Polri) recorded 2,700 reports from all over Indonesia relating to violations of the Information and Electronic Transaction Law (ITE Law 2008) during 2016. All violations related to article 27: slander, insults and expressions of hatred; Article 28 concerning hatred of the Race and Intergroup Religion (SARA) and Article 29 concerning information with threats. Half of it has been completed by the National Police, while the rest cannot yet be resolved. (National News, m.viv.co.id 6 January 2017).

 

Potential texts for forensic linguistic studies include: suicide notes, ransom requests, threatening texts, wills, anonymous hate statements (social media, letters, emails, videos, etc.), hoaxes, legal language or statute language, and others.
