Abstrak
Implementation of the Consumer Dispute Settlement by the Consumer Dispute Settlement Board in Denpasar discuss how the implementation of the settlement of consumer disputes at the Consumer Dispute Settlement Board in Denpasar and How obstacle enforcement of Consumer Dispute Settlement Board in Denpasar using juridical empirical method. This paper aims to analyze the effectiveness of the 2 Consumer Dispute Settlement Board. Implementation of the settlement of Consumer Dispute on Consumer Dispute Settlement Board in Denpasar can be divided into three types of settlement are: Mediation, Conciliation, arbitration phases and periods of settlement in accordance with Law Number 8 of 1999 on Consumer Protection, which decision Consumer Dispute Settlement Board is final and binding. In practice there are some disputes that are not resolved until the decision / closed because there has been a peace agreement between the disputing parties, have obtained compensation / damages from businesses and because consumers do not have complete evidence. There are barriers to the implementation of the Consumer Dispute Settlement Board decision in Denpasar, divided into two barriers Internal and External Constraints. Internal barriers are: Constraints judicial procedure "objection" to the district court Consumer Dispute Settlement Board in Denpasar, barriers to enforcement of the award or execution of Consumer Dispute Settlement Board and the Conflicts of rules to one another. External barriers are: Lack of socialization and the low level of awareness of consumer law and the lack of public response to the Factors Act Number 8 of 1999 on Consumer Protection and the Institute of Consumer Dispute Settlement Board in Denpasar.
