Abstrak

The Indonesian state relies heavily from this tourism industry as a source of taxes and income for companies selling services to tourists. The development of tourism in Bali province has a positive impact on sustainable development in this area. Given tourism is an integrated industry that is driven to explore all the potential of nature that will never be exhausted. Based on this matter, it is important to discuss the legal issues of responsibility of PT. Palapa Wisata Indonesia Denpasar as a travel agent for passengers on tour and travel transportation. The research method used is the type of research empirical law. Transportation management of tourism or travel agent as one element in the tour has a very strategic role. Where the management of tourist transport or travel agent that has the role of maintaining the comfort of travel tourism in every tourist who travel using travel services PT. Palapa Wisata Indonesia Denpasar. Every management of tourism transportation is required to provide the best service for tourists so that their travel tour can give a good impression. The form of responsibility given by PT. Palapa Wisata Indonesia Denpasar is referring to the agreement which has been agreed previously. On the agreement between passengers and travel agents there is an agreement with an insurance clause or no insurance. In the agreement with the insurance clause, the travel agent is responsible for taking care of the insurance claim which is the right of passenger, the travel agent will take care of everything related to the passenger. If the agreement without an insurance clause then in this case the party of the travel agent has no legal responsibility, but only provide moral support just like visiting and bring parcel. When PT. Palapa Wisata Indonesia Denpasar does not fulfill what has been promised so passengers can take legal effort to get their rights in using travel services where in operation there is an accident that is by way of dispute settlement through judicial institution (litigation) or through service outside court (non-litigation ).
