PERLINDUNGAN HUKUM BAGI PESERTA TIDAK MAMPU BPJS KESEHATAN DALAM MENGAKSES JASA PELAYANAN KESEHATAN DI RSU PURI RAHARJA (DALAM PERSPEKTIF PERLINDUNGAN KONSUMEN)

Abstract Article 4 of Law number 8 year 1999 concerning consumer protection states that in order to improve their dignities and values. The Healthcare and Social Security Agency (BPJS), especially PBI participants include people who are incapable, hospitals in providing health services should be the service which does not distinguish people’s social status in society either the rich, the poor, the ruling, the ordinary people, the smart and the fool people. research how legal protection right incapable patients as BPJS participants at Puri Raharja General Hospital in the perspective of consumer protection and what is the obstacle factor and the effort made in the implementation of BPJS program for an incapable people at Puri Raharja General Hospital. The research is important to do is to find the gap between norms with community behavior. The researcher used empirical legal research with statute approach and fact approach, that is in reviewing existing problems reviewed based on existing facts in the field and supported by disciplines and regulations that exist in relation to the problems. result showed that right of patients as BPJS participants at Puri Raharja General Hospital is not optimal in terms of health services seen in the labor case rejected by the hospital. Obstacles and efforts made in the implementation of BPJS program for an incapable people at Puri Raharja General Hospital situated in the low contribution of BPJS PBI participants and tiered health services. From the results of the study there are suggestions that, hospitals should be more prioritize patients who in emergency conditions and the government increases the contribution of BPJS healty Keywords: Protection, Consumers, Health services
