This writing is titled "Legal Status Married In The Sale and Purchase With the existence of the Agreement Kawin (Study of Law Number 1 of 1974 About Marriage)", which aims to determine the legal position of husband and wife in terms of sales and purchase agreements for mating under the Act Number 1 Year 1974 About Marriage. As a result of a marriage is the property acquired during the marriage become community property. The method used in this paper is a normative research methods. The conclusion of this paper is the buying and selling between the husband and wife who are still within the bonds of marriage declared invalid although previously had made a pact to marry. That is because buying and selling between husband and wife at odds with the purpose of marriage, and does not comply with the provisions of Article 1313 of the Civil Code and Article 1320 of the Civil Code.
