ANALISIS UNSUR-UNSUR PASAL 340 KUHP TENTANG PEMBUNUHAN BERENCANAPADA KASUS PEMBUNUHAN TRAGIS ANGGOTA ORMAS DI BALI

The research is tittled “The Analysis of Elemens in Article 340 Criminal Code About The Murder in The Case Tragic Murder of Society Organizations Mamber in Bali”. The background of this research is the presence of the tragic murder case or premeditated murder which has become big concern to sociaty. The type of research use in this study is the normative law research, the issue addressed is about the elements oh the criminal act of premaditated murder in article 340 criminal code and the accountability of the prepetrator. The research method uses a constitutional approach. Where as the analysis is based on murder case of a mamber of a sosiaty organization in Bali. It canbe concheded that the elements of premeditated murder according to article 340 criminal code which sound “Whom ever purpose fully plans and causes the loss ofsomeone’s life, will then account for it by a death penalty life sentence or maximal of 20 years.
