UPAYA YANG DAPAT DITEMPUH OLEH KREDITOR APABILA OBJEK JAMINAN FIDUSIA YANG AKAN DILELANG DIKUASAI OLEH PIHAK KETIGA

Abstrak Jaminan fidusia memberikan hak bagi pemberi fidusia untuk tetap menguasai objek jaminan fidusia. Permasalahan dapat timbul apabila pada saat akan di eksekusi objek jaminan ternyata sudah dikuasai oleh pihak ketiga. Rumusan permasalahan yaitu Bagaimanakah upaya yang dapat ditempuh oleh kreditor apabila Balai Lelang Negara tidak dapat melakukan eksekusi karena objek jaminan fidusia tersebut dikuasai oleh pihak ketiga? Metode penelitian yang dipergunakan yaitu metode penelitian hukum normatif. Berdasarkan hasil penelitian dapat diketahui bahwa Upaya yang dapat ditempuh oleh kreditor apabila Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL) tidak dapat melakukan eksekusi karena objek jaminan fidusia tersebut dikuasai oleh pihak ketiga maka kreditor dapat meminta bantuan kepada pihak kepolisian berdasarkan Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2011 tentang Pengamanan Eksekusi Jaminan Fidusia. Kata Kunci: kreditor, fidusia, lelang, pihak ketiga Abstract Fiduciary guarantee (jaminan fidusia) entitles the fiduciary giver to keep control of the object fiduciary. Problems can arise if the fiduciary object was already controlled by third parties when it was executed. The statements of problems can be formulated as follows. what are the efforts of creditors if State asset and Auction Service Office cannot execute the object of fiduciary as it has been managed by a third party? The research method used is the normative legal research method.Based on the results of this research, it can be concluded that An attempt that can be taken by creditors if KPKNL cannot do execution of the fiduciary object which is controlled by the third parties is that they can ask for help to the police by the Police Chief Regulation of the Republic of Indonesia Number 8 of 2011 concerning Execution Safety of Fiduciary Guarantee.
