ABSTRACT THE REGULATION OF RETURN ON INVESTMENT IN THE TOURIST ACCOMODATION TRADING SERVICES There are many business act ivi t ies in the touri sm indust ries in Indonesia. One of them i s the provi sion of services, speci f ical ly in Bal i . The touri st s, who are t raveled to Bal i , have a desi re to invest . Pract ical ly, in the pro vi sion of services, there are many variant s of the business which are not easy to be categori zed as a services t rading in touri sm. It has been mixed wi th other business variant s beyond the touri sm services. One of i t s variant s i s the development services a nd the management of property. I t was developed wi th the business scheme and managed wi th the management of property scheme. The problem i s, the sel ler or the developer of fer a touri sm accommodat ion services. The other problem i s that property, which has b een developed, f inanced by the foreign buyer. The property i s managed by the developer for the provi sion of touri sm accommodat ion service purposes. Further, the owner of the property got an income f rom the property management . The part ies of thi s investment model expect that income as a return of thei r investment . Thi s business model i s usual ly cal led the return on investment in the touri st accommodat ion t rading services. T h e t y p e o f t h i s r e s e a r c h , wh i c h u s e d f o r t h i s t h e s i s , i s n o rma t i v e r e s e a r c h . I t ’ s researched f rom The Investment Const i tut ion, the Touri sm Const i tut ion, The Const ruct ion Services Const i tut ion and some of regulat ions related wi th the arrangement of the return on investment . Thi s research was used material sources of law, which are primary legal material s, secondary legal material s and tert ier legal material . The resul t of thi s research show that the rules about return on investment in the touri st accommodat ion t rading services are not regulated expl ici t ly. The regulat ion h a s n ’ t b e e n r e a c h e d that return on investment act ivi t ies. I t causes lot of losses for the foreign investor. The government and the society al so get same t roubles.
