Abstrak

Work agreement is a agreement between workers / laborers with employers or providers work containing the terms of employment, rights, and obligations of the parties. One of work agreement is a certain period employement contract (PKWT). Things that could cause problems are so many violation in implementation of certain period employement contract system (PKWT), implementation of the certain period contract system (PKWT) is not corresponding to the rules on Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. This research aim for knowing how implementation of the certain period employement contract (PKWT) to the employee since enforceability of Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. This research used juridical empiric method. The result of this research is th implementation of the certain period employement contract (PKWT) at The Seminyak Oasis Villa is not optimal yet especially to appointment of employee status for employee who has been working for more than 3 years on certain period employement contract employee as regular empoyee, that’s matter effect to uncertainty employement status. The Seminyak Oasis Villa should fix their system to fit with Undangundang Nomor 13 Tahun 2003 tentang Ketenagakerjaan and to the authorized officials especially employement agencies should do supervision and coaching spaciouness.
