ALTERNATIVE DISPUTE RESOLUTION ROOTS IN INDONESIA ESPECIALLY IN BALI

Abstrak

In daily life, Alternative Dispute Rresolution has been performed and practiced in Indonesia for a long time, especially in Bali. It is a system that guarantees a quick process with a low cost by applying a “co-operative solution” which is commonly called a “win-win solution”. This process has taken on various methods of application, as can be seen in three distinct periods of Indonesia's history.This paper will describe further, the history and the methods used in the application. By using normative legal studies, this study also emphasizes the historical approach. With a historical approach will be observed the development of Alternative Dispute Resolution, especially in Bali.
