KEDUDUKAN WAKIL PRESIDEN DALAM MEMPERKUAT SISTEM PEMERINTAHAN PRESIDENSIAL DI INDONESIA BERDASARKAN UUD 1945

Abstrak

The Presidential Government system is led by a President and Vice President. Often the duties and authority of The Vice President are not clearly known. This study addresses two main problems. First, how is the position of Vice President in presidential system in Indonesia? Second, how is the Vice President accountable during his tenure? The problem is investigated by using normative legal research method by using conceptual approach and also approach of legislation. Techniques of collecting legal materials using literature study techniques and then followed by analytical techniques. The results of research indicate that the duties and authorities of the Vice President are not expressly regulated through the 1945 Constitution and the laws and regulations under it so that the granting of duties and authority of the Vice President shall be conducted by the President. with the possibility of objective factors and subjective factors in the assignment of duties and authority. Meanwhile, on various occasions the Vice President can also act as a companion for the President in performing his obligations. Thus the Vice President has five possible positions as representatives representing the President, in place of the President, assisting the President, as a companion who accompanies the President, as an independent Vice President. From the results of research on Vice Presidential accountability, the issue surrounding the Vice President related to the responsibilities of a Vice President is unclear. The Vice President is not responsible to the President because the Vice President is not appointed by the President but by the people. There is no article in the 1945 Constitution which governs the accountability of the Vice President, either as Deputy Head of Government or as Deputy Head of State.
