Abstrak
Generally customary law is
formulated by men, so certain parts of the law position women in a marginal
position, even harming women. This is also evident in the construction of
Balinese inheritance customary law, which is not only constructed in
patrilineal kinship, but also its implementation is ruled and managed by men.
Therefore, all considerations in managing the distribution of inheritance
generally follow the "power" of men, who develop projects forget
about sisters. This book presents the results of a normative and empirical
study in recognizing the inheritance rights of Balinese women. The development
of inheritance customary law was also formalized in Bali, which despite the
recent Pakraman Village Assembly of the Province of Bali producing a formula
that responds to gender, but its implementation has not shown the same spirit.
